Facinho Terms of Use (beta version)

These terms apply to the Facinho Smurfs store and to Mercado Facinho, which is in beta. This is the beta draft: the text may change while the marketplace is being tested, and every change is published on this page with the new date. By buying, selling or using the affiliate program, you declare that you have read and agree to them.

Who we are and what these terms cover

Facinho Smurfs sells game accounts in the store at facinhosmurfs.com.br, with automatic delivery by email. Mercado Facinho (mercado.facinhosmurfs.com.br) is a marketplace in beta where players buy and sell among themselves, with Facinho holding the funds in escrow. The official contact channels are listed at the end of this page. The Privacy Policy and the Cookie Policy are part of these terms.

Who can use it

The site is for people aged 18 or over only. If we find out a purchase was made by someone under 18, we cancel the order and refund the amount.
To buy and sell on Mercado Facinho, your account must have a verified email.
Use an email address that is yours and that you can access: it is where the store sends the account you bought.

Game risks

Facinho Smurfs is not affiliated with, sponsored or endorsed by Riot Games or any other game company. Those companies' rules may not allow selling or transferring accounts, and they may suspend, ban or recover an account at any time. This risk is why the warranty below exists. Knowing the risk does not take away any of your rights.

Buying in the store

You buy access to an account with the characteristics of the listing, which is part of the contract.
At guest checkout we only ask for your email. The account arrives there automatically right after the payment is confirmed, at any hour.
We do not promise rank, performance or results in matches.
After delivery, change the password and register your own email on the account. Never share the access details.

Buying and selling on Mercado Facinho

Escrow: the buyer pays Facinho. The amount stays held and is only released to the seller at the end of the warranty, if there is no dispute.
Delivery: automatic (the details appear in "My purchases" when the payment is confirmed) or manual (the seller sends them in the sale chat within 24 hours after the payment is confirmed).
Sellers: anyone can sell in the beta. 2FA is required to create listings and keep them active. Listings go through moderation before they appear, and the seller is responsible for what they list and deliver.
Commission: the Mercado Facinho commission is shown in the panel before you publish the listing.
Negotiating or receiving payment outside the platform is forbidden. Facinho never asks for passwords, 2FA codes, card details or documents by chat, email, WhatsApp or Discord. See Scams and how to protect yourself.

Payment

Payment is made by PIX (Mercado Pago, with a QR Code on screen) or credit card (Stripe, without leaving the page). Your bank may ask for a confirmation in its app; if it does, complete it. Outside Brazil, payment is automatically by card. On Mercado Facinho, the buyer pays no extra fee on PIX or card. Payment in cryptocurrency: coming soon. Details in Payment methods.

Warranty, disputes and refunds

Store: 7-day warranty after the purchase. If the account is banned for botting within that period, we replace it with an equivalent account, subject to availability and excluding misuse. The warranty covers the skin shard, not the skin built from it.
Mercado Facinho: standard warranty of 7 days; the seller may offer more, up to 90 days. The period of your purchase is fixed from the moment you buy.
Dispute: in "My purchases", within the warranty and before you confirm receipt, with a description and screenshots. The amount stays held and the team decides with the evidence from both sides, reviewing within 24 business hours of the opening.
Early confirmation: if you confirm receipt, the seller is paid sooner and the possibility of a dispute ends. It cannot be undone.
Refund: on Mercado Facinho, only through a dispute within the warranty, in the currency of the payment. The team decides.
Disputing a payment without a valid reason voids the warranty and support for that purchase.

Withdrawals and identity verification

Sellers withdraw the Released balance of the wallet by PIX. The minimum is R$ 50, with no maximum, and only one withdrawal can be open at a time.
Withdrawals are paid within 3 business days.
Identity verification (KYC) is required only to withdraw. To sell, it is not.
A new withdrawal destination or a password change blocks withdrawals for 72 hours, for security.

Affiliate program

Sign-up is open to everyone and manually approved by the team. The affiliate's commission comes out of the platform fee: buyers and sellers do not pay more. The percentages and rules are in Affiliate program. To withdraw the commission, you need identity verification and 2FA turned on.

What is not allowed

Using another person's payment method or data without authorization.
Getting around price, coupon, stock or warranty, or creating accounts and orders to commit fraud.
Attacking, overloading or trying to break into the site, the API or the payment systems. Anyone who reports a flaw in good faith, without accessing third-party data, is protected by our bug bounty program.
Pretending to be Facinho or asking for other users' data.

We may suspend accounts, pause listings, hold amounts tied to fraud and notify the authorities. Regular purchases that are already paid keep your rights.

Responsibilities

Facinho is responsible, as the law provides, for the information in the listings it publishes itself, for delivery and for the security of the data it handles. Facinho is not responsible for changes made by the game companies, for the unavailability of their servers, for problems with your device or internet, or for acts of yours or of anyone who received your access details. Nothing in these terms limits rights that the law gives you.

Personal data and cookies

We only process the data needed to sell, deliver, charge and protect purchases, as explained in the Privacy Policy. Analytics and marketing cookies only work with your consent. Requests about your data (LGPD) follow the path described in the policy.

Changes to these terms

Each version has a number and a date. The version that applies to your purchase is the one published on that day. Changes apply to future purchases; a change that is more favorable to you may also apply to earlier ones. Because this is a beta, the text may be revised often.

Governing law and support

These terms follow Brazilian law, especially the Consumer Protection Code. You may bring a claim in the courts of your place of residence.
